Abstract

In this research by Legal Protection of Taxi driver based on online at PT. Grab Imdonesia, the purpose of this research are 1) To analze legalistic and legal contruction (status, position, rights. And obligation) of PT. Grab and taxi drivers in online road based on transport agreement. 2) to find out whether the legality and legal contruction of online ground – based transport agreements has provided legal protection against online taxi drivers, and 3) to analyze the concept of legal protection of online taxi drivers (in the future this research is driver and consumer service users of PT. Grab Palembang, with the methode normative to argement explaining descriptive qualitative. Data sources of this study are : legal entities, secondary legal entities and legal entities. Data processing is done by qualitative descriptive method. The result showed that : the relationship between PT. Grab and driver is a partnership, so legal basis used is Civil Code and operational technical implementation is based on Regulation of the minister of transportation No. 108 of 2017, legal regulations have not provided legal protection fir drivers due to rules that have not specifically set up relationship between application providers legal protection for drivers. The concept of legal protection of taxi drivers in the implementation of online transaction agreements begins with the formation of legal entity is formed then made clear rules about the rights and obligations of the parties either PT. Grab and drivers who carry out the cooperation.
