Abstract

Notaries play an important role in the implementation process of credit relaxation and restructuring in the conventional banking sector during the Covid-19 pandemic in Palembang. The Covid-19 situation has had an impact on debtors, especially MSME debtors. The government, through the Financial Services Authority, has issued policies in the form of credit relaxation and restructuring. The purpose of this research is to identify, analyze, and discover the roles of notaries in the implementation of credit relaxation and restructuring in the conventional banking sector during the Covid-19 pandemic in Palembang, to understand the legal strength of the credit restructuring agreement deed in resolving non-performing loans caused by the impact of the Covid-19 pandemic on the banking sector, and to understand and analyze the resolution of legal disputes in the event of non-performing loans in the conventional banking sector during the Covid-19 pandemic. This research was conducted normatively with empirical data support. The results show that the role of notaries in implementing credit relaxation and restructuring during the Covid-19 pandemic includes creating authentic deed of credit agreement changes, legalizing and waarmerking the deed made under the table, and providing legal advice on the deeds made by notaries. The legal strength of the credit restructuring agreement deed in resolving non-performing loans caused by the impact of the Covid-19 pandemic has perfect evidence if it is made authentically, but in banking practices, some deeds are made under the table, which may raise objections from the parties if there is a lawsuit from the evidentiary side. In general, non-litigation is prioritized in resolving legal disputes in the event of non-performing loans in the conventional banking sector during the Covid-19 pandemic, while litigation is the last resort. It can be concluded that notaries, relatively and ideally, have a crucial role in the implementation process of creating a deed of credit relaxation and restructuring in the conventional banking sector during the Covid-19 pandemic. It is expected that banks provide clear rules on legal protection for debtors, the government should provide in- depth explanations about the procedural flow of credit restructuring policy programs, and notaries should be more actively involved in the programs established by the government.
