Abstract

Skripsi ini berjudul “Implementasi Peraturan Mahkamah Agung Nomor 2 Tahun 2012 Terhadap Pelaku Tindak Pidana Ringan(Studi Putusan Nomor 6/Pid.C/2021/PN Kag dan Putusan Nomor 2/Pid.C/2022/PN Plg)”. Rumusan masalah dalam skripsi ini ialah Apa pertimbangan hakim dalam penjatuhan pidana terhadap pelaku tindak pidana ringan (Tipiring) dalam Putusan Pengadilan Negeri Kayuagung Nomor 6/Pid.C/2021/PN Kag dan Putusan Pengadilan Negeri Palembang Nomor 2/Pid.C/2022/PN Plg dan Bagaimana Implementasi Peraturan Mahkamah Agung Nomor 2 Tahun 2012 dalam Putusan Nomor 6/Pid.C/2021/PN Kag dan Putusan Nomor 2/Pid.C/2022/PN Plg sanksi pidana denda oleh aparatur penegak hukum bagi pelaku tindak pidana ringan (Tipiring) berdasarkan Peraturan Mahkamah Agung Nomor 2 Tahun 2012. Metode penelitian dalam skripsi ini menggunakan jenis penelitian normatif dengan menggunakan jenis data skunder. Hasil dari penelitian ini ialah pertimbangan hakim secara yuridis dimana berisi unsur-unsur tindak pidana pencurian dan non yuridis dimana berisi dua aspek, yaitu aspek sosiologis dan aspek filosofi dalam Putusan Nomor 6/Pid.C/2021/PN Kag dan Putusan Nomor 2/Pid.C/2022/PN Plg telah tepat adapun Implementasi sanksi pidana denda bagi pelaku tindak pidana ringan (Tipiring) berdasarkan Peraturan Mahkamah Agung Nomor 2 Tahun 2012yang dilakukan di Pengadilan Negeri Kayuagung dan Pengadilan Negeri Palembang, perkara tindak pidana pencurian ringan telah sesuai, pada Putusan Nomor 6/Pid.C/2021/PN Kag dan Putusan Nomor 2/Pid.C/2022/PN Plg digunakan teori pemidanaan berupa teori relatif atau teori tujuan (doel theorien).
