Abstract

Skripsi ini berjudul “PERTIMBANGAN HAKIM DALAM MENJATUHKAN PIDANA TERHADAP TINDAK PIDANA PELAKU KORUPSI DANA DESA” (Putusan Nomor : 12/Pid.Sus-Tpk/2020/PN.Plg) dan (Putusan Nomor : 43/Pid.Sus-Tpk/2021/PN.Plg), yang melatarbelakangi dalam skripsi ini yakni, banyaknya kasus korupsi yang dilakukan oleh Pejabat Pemerintah Desa (Kepala desa). Permasalahan yang penulis angkat dalam penulisan ini agar melihat serta menganalisis dasar Pertimbangan hakim dalam menjatuhkan pidana serta bagaimana penerapan pemidanaan terhadap Tindak Pidana Korupsi Dana Desa (Putusan Nomor : 12/Pid.Sus-Tpk/2020/PN.Plg) dan (Putusan Nomor : 43/Pid.Sus-Tpk/2021/PN.Plg), ditinjau dari pemidanaan, metode penelitian yang digunakan adalah jenis penelitian hukum normatif. Dari hasil penelitian menunjukan bahwa dalam menjatuhkan putusan, hakim memperhatikan aspek yuridis dan non yuridis yang mana terdakwa terbukti secara sah dan meyakinkan telah melakukan Tindak Pidana Korupsi Dana Desa sesuai dengan Undang-Undang Nomor 20 tahun 2001 tentang perubahan atas Undang-Undang Nomor 31 tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi. Dari penulisan skripsi ini penulis menarik kesimpulan bahwa dalam penjatuhan vonis, hakim telah memperhatikan segala aspek yang berkaitan dengan pokok perkara agar putusan sesuai dengan teori pertimbangan hakim dan teori pemidanaan dengan asas gabungan yaitu berlandaskan pada tujuan dan efek jera kepada pelaku tindak pidana korupsi.
