Abstract

This study aims to analyze the application of vicarious liability to notaries/land deed officials for their Employees who forge signatures without their knowledge. It is normative legal research using statutory, conceptual, and case approaches. The results confirm that a notary in carrying out his duties and obligations must be based on the Notary Office Regulations to safeguard the interests of the parties when carrying out legal actions. The notary/land deed officials in this case are assisted by employees for office administration in drawing up deeds or other documents. To speed up the administrative process, notary employees sometimes misuse their authority causing a violation of the law. As in the Decision of the Madiun District Court Number 158/Pid.B/2019/PN.Mjy, the case started with Lia Wahyu Anggraini, an employee of Dany Ermawan, SH.M.Kn. who forged Deed of transfer of land titles. In this context, there is a legal relationship between them that gives rise to a right and obligation. If an employee makes an error, it is not only the employee's personal responsibility, but also the responsibility of the notary/land deed official. They are also responsible because the violation occurred within the scope of their office.
