Abstract

Judul Skripsi “Pertimmbangan Hakim Dalam Menjatuhkan Pidana Terhadap Pelaku Tindak Pidana Korupsi Pada Delik Gratifikasi (Studi Putusan No 65/Pid.Sus-TPK/2021/PN. Plg) Dan (No 77/Pid.Sus-TPK/2019/PN Pdg)’’. Dalam Skripsi Ini Timbul Beberapa Masalah: 1. Bagaimana Pertimbangan Hakim Dalam Menjatuhkan Putusan No 65/Pid.Sus-TPK/2021/PN. Plg) Dan (No 21Pid.Sus- TPK/2019/PN Pdg) Terhadap Tindak Pidana Korupsi Gratifikasi 2. Bagaimana Pertanggungjawaban Pidana Terhadap Pelaku Tindak Pidana Korupsi Dengan Gratifikasi. Metode yang digunakan yaitu penelitian normatif dengan menggunakan pendekatan Perundang-Undangan (Statute Approach) dan Pendekatan Perbandingan (comparative approuch), dengan teknik penarikan kesimpulan. Penelitian Ini Untuk Mengetahui Dasar Hukum Pertimbangan Hakim Pengadilan Negeri Di Beberapa Wilayah Indonesia Dalam Menjatuhkan Putusan (No 65/Pid.Sus-TPK/2021/PN. Plg) Dan (No.21/Pid.Sus-TPK/2019/PN Pdg). Adapun kesimpulan Berdasarkan hasil penelitian dan analisis data yang telah dilakukan maka dapat disimpulkan bahwa yang menjadi Dasar Hukum Pertimbangan Hakim Dalam Menjatuhkan Putusan Terhadap Tindak Pidana Korupsi Pada Bentuk Gratifikasi yaitu adalah unsur setiap orang, memberikan atau menjanjikan sesuatu, kepada pegawai negeri yang mana telah tertulis Sesuai Pasal 5 Ayat (1) Huruf b.
