Abstract

The purpose of this study is to analyze the legal force of a house sale and purchase binding agreement (PPJB) made with a notarial deed, analyze the legal protection of consumers in a sale and purchase binding agreement (PPJB) whose delivery of housing units is delayed and to analyze the legal considerations of judges in giving decisions. This research uses a normative research method using a case-based approach, and uses legal materials such as laws, philosophies, scientific papers, books, journals related to the theme of writing. This research uses primary, secondary and tertiary legal materials. The use of PPJB in the implementation of a house purchase agreement with a developer often causes conflict in the end, several possibilities can occur, including because the buyer does not understand the essence of the PPJB until the developer often defaults, causing losses to consumers which lead to mutual lawsuits in court. The results of this study explain that the PPJB is not a sale and purchase agreement, but an agreement to sell and purchase, meaning that the sale and purchase has not been carried out because the principle of cash and light has not been fulfilled, the PPJB is made by notarial deed has binding legal force and authentic value as written evidence. And in the event of a home purchase default by the developer while the buyer has carried out and fulfilled his obligations, the developer can be sued and held accountable, in the case of the buyer as the plaintiff and the developer as the defendant resolving this consumer dispute at the arbitration institution, namely the Consumer Dispute Resolution Agency which has final power and without appeal.
