Abstract

Skripsi ini berjudul “Pertanggungjawaban Pidana Terhadap Pegawai Swasta Sebagai Pelaku Tindak Pidana Pencucian Uang (Studi Kasus Putusan Nomor: 173/Pid.B/2014/PN.Jkt.Sel)”. Adapun rumusan masalah yang akan dibahas adalah apa pertimbangan hakim dalam menjatuhkan putusan terhadap pelaku tindak pidana pencucian uang dalam perkara Studi Kasus Putusan Nomor: 173/Pid.B/2014/PN.Jkt.Sel dan pertanggungjawaban pidana terhadap pegawai swasta sebagai pelaku tindak pidana pencucian uang yang dengan sengaja menyalagunakan aturan kerja sebagai pegawai swsata. Penulisan skripsi ini menggunakan metode penelitian yuridis normatif. Bahan hukum yang digunakan adalah bahan hukum primer, sekunder dan tersier. Dari hasil penelitian diketahui bahwa hakim dalam menjatuhkan putusan harus berdasarkan aspek yuridis, dan aspek sosiologis,agar tidak terjadinya putusan yang tidak adil atau merugikan terdakwa.Pelaku tindak pidana pencucian uang yang dengan sengaja menyalagunakan aturan kerja sebagai pegawai swsata,dapat dijatuhkan sanksi pidana apabila sudah terpenuhinya delik tindak pidana perpajakan dan Dari analisis penulis dapat diketahui bahwa putusan diatas telah memenuhi syarat subjektif dan objektif serta tujuan Pemidanaan. Kata Kunci :Pertanggungjawaban Pidana, Tindak Pidana Pencucian Uang, Pertimbangan Hakim.
