Abstract

Research on the implementation of discipline penalty for State Civil Apparatus (ASN) who is not attending work and obeying the provisions of working hours through the Human Resources Development and Human Resources Agency (BKPSDM) of Palembang is based on the background at Palembang City’s Government ini 2015, 2016 and 2017, finding some of violation of the highest ASN discipline who is not attending work and obeying the provisions of working hours. The research problem is how to apply and the constraints in discipline penalty for ASN that not attending work and obeying the provisions of working hours through the BKPSDM of Palembang City. This type of research is empirical legal research, with the type and source of research material obtained from primary data and secondary data through literature and field studies. The data analyzed by qualitatively, with deductive deduction techniques. The result of this study is that the application of disciplinary penalty for ASN that not attending work and obeying the provisions of working hours through BKPSDM in Palembang City has reduced the level of disciplinary violations, and implemented through implementing regulations of PP No. 53 of 2010 concerning Civil Servants Discipline, is circular letter of Palembang Mayor No. 800/071/BKPSDM.V/2018 concerning Development of ASN Discipline, Decree of Mayor of Palembang No. 005/KPTS/BKPSDM-V/2018 concerning the Establishment of the ASN Discipline Examination Team, and Palembang Mayor Decree No. 006/KPTS/BKPSDM- V/2018 concerning the Establishment of the Implementation Advisory Board for the Imposing of the ASN Discipline Penalty. Obstacles to discipline penalty for ASN that not attending work and obeying the provisions of working hours through the BKPSDM of Palembang City, is from law enforcement/apparatus factor, the offiicial of Examining Team and the Consideration Team are not in place because the appointed officials have busy and authorized tasks and responsibilities of their respective principal positions. From cultural factor to legal awareness, is lack of direct supervisor responsibility; and SKPD directly delegates cases of alleged discipline violations to BKPSDM.
