Abstract

The title of this thesis is “Legal Protection of The Copyright of Graphic Design of Dream Theater’s CD Album Cover from Commercial Use” which will discuss about: how is the legal protection of the copyright of graphic design of Dream Theater’s CD Album Cover from commercial use in an attempt to achieve justice in the future. This research uses prescriptive method where legal research is made with the aim of studying the objectives of law, values of justice, validation of legal rules, legal concepts, and legal norms using the Legal Approach, Conceptual Approach, Legal Philosophical Approach, Legal Historical Approach, Case Approach, and Analytical Approach. Legal materials used in this thesis are primary, secondary and tertiary legal materials, which are considered relevant to legal issues that will be discussed in this thesis research. The results of the study of legal issues above are: Firstly legal protection towards copyright of Graphic Design on Images of Dream Theater’s Album Cover from commercial use can be done in 2 (two) ways, by preventive protection which is provided by the government in order to prevent violations by registering Copyright or Industrial Design into the Directorate General of Intellectual Property and by repressive means, where the protection is provided by the government with the aim of resolving disputes if there is a violation of the copyright on graphic design by submitting a lawsuit to the Commercial Court. Secondly, in case of violation, it is better for the both parties to choose a settlement because it does not cost much for only one type of invention. Besides that, through deliberations (musyawarah), the settlement does not need to be complicated because only an agreement between two parties and reasonable compensation for parties whose rights have been violated are needed. Thus justice was created from both parties and no one was harmed.
