Abstract

The title of this thesis was "The Essence and Functions of the Principle of Kinship in the Management of Saving and Loan Cooperation and Their Application in the Court Decisions" which discussed: How is the essence and function of the principle of kinship in the management of the normed Savings and Loans Cooperation in the Laws and Regulations, How is the principle of kinship manifested in the management of Savings and Loans Cooperation in the Articles of Association of Savings and Loans Cooperation, How to Judge Legal considerations in the Yogyakarta District Court Decision No. 119 / Pdt.G / 2015 / PN. YK which used the principle of kinship in the management of cooperation while the Sukoharjo District Court Decision No. 97 / Pdt.G / 2015 / PN.Skh did not use the principle of kinship, how to normalize the principle of kinship in the management of Savings and Loans Cooperation in the legislation and the Articles of Association of Savings and Loans in the effort to achieve the objectives of the Cooperative in the future. The method used in this thesis research was prescriptive, the legal research aimed to study the purpose of the law, the values of justice, validation of the rule of law, legal concepts, and legal norms by using the Law Approach, Conceptual Approach, Case Approach, Approach Analytical, Historical approach to Law and Comparative approaches. Legal materials used in this thesis were primary legal materials, secondary and tertiary legal materials, which were considered relevant to legal issues that were discussed in this thesis research. The results of the research were related to the above legal issues: First the meaning of the principle of kinship is philosophical and juridical in which this principle of kinship is a principle that is indeed in accordance with the soul and personality of the Indonesian people. Secondly, the principle of kinship embodied in the management of Savings and Loans Cooperation in the Articles of Association of Savings and Loans Cooperative applied in the Employee Cooperative Pusri was by way of deliberation to reach consensus that can take the form of negotiation and mediation carried out by the management. Third, to explain the Judicial Legal considerations in the Yogyakarta District Court Decision No. 119 / Pdt.G / 2015 / PN. YK which used the principle of kinship in the management of cooperation while the Sukoharjo District Court Decision No. 97 / Pdt.G / 2015 / PN. did not use the principle of kinship. Fourth For efforts to achieve the objectives of the Cooperative in the future it is indeed not easy to realize an ideal cooperative for that it requires understanding and good faith from the Government and all parties.
