Abstract

This thesis is entitled "Study of Setting Requirements for Candidates for Regional Heads Former Corruption Convicts with Former Narcotics Convicts Based on General Election Commission Decree Number: 394 / Pl.02-2-Kpt / Kpu / Viii / 2020". This writing is motivated by the occurrence of disparities for regional head candidates who are former convicts in narcotics cases, the KPU decision Number 394 of 2020. stipulates that a candidate who is identified as a narcotics user is someone who has been decided by the court as a victim, the disproportionality in the provisions as a victim is present considering Comparatively, there are rules for allowing convicts of corruption and other criminal acts to open their access to participate in regional head elections, namely MK Decision No. 42/PUU-XII/2015. From this, problems arise that must be analyzed, namely: (1) How to Arrange the Requirements for Candidates for Regional Heads Who Are Former Corruption Convicts and Former Narcotics Convicts Based on General Election Commission Decree Number: 394 / Pl.02-2- Kpt / Kpu / Viii / 2020 (2) What are the Future Arrangements for Regional Head Candidates Identified as Former Convicts so that there are no gaps in the Criminal Law. The research approach that the author uses in this research is a statutory, conceptual, case approach, historical and futuristic approach. The results of the research are that the Regulations for the Nomination of Regional Heads Identified as Former Convicts are sufficiently regulated by one constitution such as the Constitutional Court Decision No. 42 of 2015, there is no need to complicate it with the KPU Decree Number 394 of 2020 so that political rights between ex-convicts, both ex-convicts of corruption and ex-narcotics convicts are not discriminated against.
