Abstract
Import can be defined as the purchase of goods from foreign countries in accordance with government regulations, paid for using foreign currency. Article 50 of Law Number 7 of 2014 states that all goods can be exported or imported , expect those prohibited, restricted, or otherwise determined by the law. Prohibited imported goods are regulated by the Minister of Trade of the Republic of Indonesia Regulation No. 18 of 2021 Article 2. This research aims to determined why the goods referred to in Minister of Trade Regulation No. 18 of 2021 are prohibited from being imported and how law enforcement is carried out against the criminal offense of importing such prohibited goods. This research is a juridical-normative study. Legal research is a process of discovering legal rules, legal principles, and laws to address legal issues. This research uses qualitative analysis method for drawing conclusions. The analysis results shows that the prohibition of importing prohibited goods into the territory of the Republic of Indonesia aims to protect the interests of the nation and the State, as it can disrupt defense, security, and public order, harm human health, damage the environment, disrupt industry, trade, and finance, and damage cultural heritage. Law enforcement gains prohibited imported goods includes administrative sanction such as seizure of goods and payment of customs duties, and criminal sanctions for importing prohibited goods, as regulated in Article 110 and 112 of Law No. 7 of 2014, and cumulatively, criminal penalties and fines can work in synergy with Customs Law.
