Abstract

Penelitian ini bertujuan untuk menganalisis kedudukan jual beli dibawah tangan yang dilakukan dengan membuat kuitansi sebagai tanda bukti jual beli dan untuk menganalisis kekuatan hukum atas jual beli hak milik atas tanah dibawah tangan Pendekatan yang digunakan Pendekatan Perundang- Undangan (Statute Approach), Pendekatan Konsep (Conseptual Approach) dan Pendekatan Futuristik. hasil penelitian ini menegaskan bahwa Proses pendaftaran peralihan hak atas tanah melalui jual beli menurut Peraturan Pemerintah Nomor 24 Tahun 1997 meliputi persiapan pembuatan akta jual beli hak atas tanah, terlebih dahulu PPAT wajib melakukan pemeriksaan pada kantor pertanahan kabupaten/kota mengenai keabsahan sertifikat hak atas tanah yang bersangkutan. peralihan hak milik atas tanah melalui jual beli dengan akta di bawah tangan dalam kaitannya dengan Peraturan Pemerintah Nomor 27 Tahun 1997 Pasal 37 ayat (1),bukan merupakan alat pembuktian yang kuat. Pembaharuan hukum terhadap pendaftaran hak milik atas tanah pada Tahun 2021 sudah cukup untuk mengatasi permasalahan yang ada saat ini, pendaftaran secara elektronik mempermudah masyarakat serta menghindari sertifikat palsu atau double sertifkat yang sering terjadi selama ini. Kata Kunci: Peralihan Hak Milik, Jual Beli Tanah, DiBawah Tangan.
