Abstract

Penelitian ini berjudul Pertanggungjawaban Pidana Pelaku Tindak Pidana Pengeroyokan (Studi Putusan Pengadilan Negeri Kota Timika No. 137/Pid.B/2020/PN. Tim dan Putusan Pengadilan Negeri Kebumen No.30/Pid.B/2020/PN. Kbm). dengan rumusan masalah dari penelitian ini adalah untuk melihat bagaimana pertanggungjawaban pidana pelaku pengeroyokan dan apa yang menjadi dasar pertimbangan hakim dalam menentukan hukuman dalam Putusan Pengadilan Negeri Kota Timika No. 137/Pid.B/2020/PN. Tim dan Putusan Pengadilan Negeri Kebumen No.30/Pid.B/2020/PN. Kbm. Di latar belakangi untuk mengetahui peran masing-masing pelaku tindak pidana pengeroyokan yang disebutkan dalam Pasal 170 KUHP. Metode penelitian yang digunakan adalah metode penelitian normatif serta dengan metode pendekatan penelitian berupa Pendekatan Kasus (Case Approach) dan Pendekatan Perundang-undangan (Statute Approach). Penelitian ini dilakukan untuk mendalami suatu kasus pengeroyokan yang mana memahami peranan tiap pelaku sebagai tindak pidana pengeroyokan. Dengan didasari teori pertanggungjawaban pidana, dan teori pertimbangan hakim dalam putusannya sebagai acuan dasar peneliti dalam menganalisis setiap penindakan pelaku tindak pidana pengeroyokan.
