Abstract

Land is a part of the earth called the earth's surface, land is one of the objects regulated by Agrarian Law. The Basic Agrarian Law is a basic rule that regulates rights to land, water and air, so it is very important to plan land use activities in a tertive, effective and efficient manner. This research discusses two problem formulations which include how to implement the registration of Cultivation Rights for land use for management rights at PT. Sumatra Asia Mandiri (SAM) Kayu Ara Batu village, Muara Belida District, Muara Enim Regency, as well as what kinds of obstacles arise in registering land use rights for management rights and what resolution efforts are taken at PT. Sumatra Asia Mandiri (SAM) Kayu Ara Batu village, Muara Belida District, Muara Enim Regency. This research uses empirical juridical legal research. The result of this research is the implementation of registration of PT's Business Use Rights. Sumatra Asia Mandiri (SAM) cannot be implemented until now because the Cultivation Rights of PT. Sumatra Asia Mandiri (SAM) has not registered a location permit for an oil palm plantation based on information from the Head of Kayu Ara Batu Village who checked at the ATR/BPN office of Muara Enim Regency, because there is a land dispute which is the customary land of the Kayu Ara Batu village community. appears in the registration of land use rights for management rights. There is no agreement between PT. Sumatra Asia Mandiri (SAM) with farming communities around the location, regarding the provision of plasma plantations for communities around the Company's location, so that land registration cannot take place yet. Dispute resolution adopted by PT. Sumatra Asia Mandiri (SAM) is to conduct proper and direct deliberations with the Kayu Ara Batu village community, represented by the village head and traditional leaders. And the community has made a complaint to the Plantation Service through a letter of demand from the Kayu Batu village community against PT. Sumatra Asia Mandiri (SAM).
