Abstract

This research is motivated by the act of passing off which is actually known in the common law legal system and has not been recognized in the legal system in Indonesia. However, in reality, the act of passing off has occurred in Indonesia from the past until now. The purpose of this thesis research is to find out and analyze the legal protection given to the owner of a well-known trademark for the act of passing off along with the judge's consideration in deciding the case relating to it. The formulation of the problem of this thesis is regarding the legal protection of well-known trademark owners for passing off and the judge's consideration in deciding Putusan Nomor 520 K/Pdt.Sus-HKI/2021 when associated with passing off. This thesis is a normative legal research using a statutory approach, case approach, and analytical approach. The results of this study indicate that legal protection must be given to the owner of a well-known trademark preventively and repressively. It is necessary to specifically regulate passing off in Indonesia accompanied by a more assertive and thorough trademark registration agency and law enforcement that strictly imposes sanctions. When associated with the act of passing off, the judge in deciding Putusan Nomor 520 K/Pdt.Sus-HKI/2021 has fulfilled the elements of justice, certainty, and expediency.
