Abstract

SKRIPSI INI DITULIS DENGAN JUDUL PEMENUHAN HAK RESTITUSI TERHADAP ANAK KORBAN TINDAK PIDANA KEKERASAN SEKSUAL. TUJUAN PENELITIAN INI UNTUK MENGETAHUI PERLINDUNGAN HUKUM DAN PEMENUHAN HAK RESTITUSI YANG DIBERIKAN KEPADA ANAK KORBAN TINDAK PIDANA KEKERASAN SEKSUAL. PENELITIAN SKRIPSI INI MENGGUNAKAN METODE PENELITIAN HUKUM NORMATIF (YURIDIS NORMATIF). PERLINDUNGAN HUKUM MERUPAKAN TINDAKAN YANG DILAKUKAN UNTUK MENJAMIN PEMENUHAN HAK-HAK KORBAN. PENELITIAN INI MELIHAT PERLINDUNGAN YANG DIBERIKAN MELALUI KUHAP, KUHP, UNDANG-UNDANG PERLINDUNGAN ANAK, UNDANG-UNDANG PERLINDUNGAN SAKSI DAN KORBAN, SERTA UNDANG-UNDANG TINDAK PIDANA KEKERASAN SEKSUAL. PERAN LPAII, KPAI, DAN KOMNAS PA SEBAGAI LEMBAGA YANG DIBENTUK UNTUK MELAKUKAN PEMANTAUAN, PANGAWASAN, PENDAMPINGAN, DAN MEMBERIKAN BANTUAN HUKUM AGAR PELAKSANAAN PEMENUHAN HAK ANAK DISELENGGARAKAN DENGAN BAIK. PEMENUHAN RESTITUSI SEBAGAI SALAH SATU HAK ANAK MEMILIKI KELEMAHAN DALAM PENGATURANNYA ANTARA LAIN: JANGKA WAKTU DALAM PENGAJUAN RESTITUSI YANG SINGKAT DAN RUMIT;ADANYA SUBSIDER SANKSI RESTITUSI BERUPA KURUNGAN MEMBUAT TIDAK ADA UPAYA PAKSA BAGI PELAKU UNTUK MEMBAYAR RESTITUSI; DAN RENDAHNYA RESTITUSI YANG DIPUTUS OLEH HAKIM DENGAN PERTIMBANGAN KEMAMPUAN, KEMAUAN, SERTA KONDISI PELAKU.
