Abstract

Skripsi ini berjudul “Penerapan Asas Transitoir Terhadap Pelaku Tindak Pidana Penebangan Hutan Liar (Studi Putusan Nomor 84/Pid.B/LH/2020/PN Wns”. Rumusan masalah yang diangkat dalam penulisan skripsi yaitu: Pertimbangan Hukum Hakim Terhadap Pelaku Tindak Pidana Penebangan Hutan Liar (Studi Putusan Nomor 84/Pid.B/LH/2020/PN Wns) dan Penerapan Asas Transitoir Terhadap Pelaku Tindak Pidana Penebangan Hutan Liar (Studi Putusan Nomor 84/Pid.B/LH/2020/PN Wns. Metode penelitian yang digunakan ialah jenis penelitian hukum normatif, yang mana penelitian ini menggunakan analisis secarakualitatif preskriftif. Dari penelitian ini memperoleh hasil yang dapat disimpulkan bahwa yang menjadi pertimbangan hakim dalam menjatuhkan putusan berdasarkan dakwaan kedua serta memenuhi unsur Pasal 82 Ayat (1) Undang-Undang No. 18 Tahun 2013 Tentang Pencegahan Dan Pemberantasan Perusakan Hutan. Kemudian penerapan asas Transitoir pada tindak pidana penebangan liar, dalam putusan di atas Jaksa Penuntut Umum dan Majelis Hakim tidak mengindahkan asas transitoir, sehingga dalam mengadili para terdakwa tetap menggunakan Undang-Undang Nomor 18 Tahun 2013 Tentang Pencegahan Dan Pemberantasan Perusakan Hutan.
