Abstract

This thesis is entitled "Disparities in the Imposition of Criminal Sanctions on Children in Cases of Theft with Aggravation (Study of Decision No. 39/Pid.Sus-Anak/2022/PN Mre and Decision No. 15/Pid.Sus-Anak/2022/PN Plg)" . The problem in this research is what is the basis for the judge's consideration in imposing criminal sanctions on children who commit theft in Decision No. 39/Pid.Sus-Anak/2022/PN Mre and Decision no. 15/Pid.Sus-Anak/2022/PN Plg and How is the concept of aggravation in the crime of theft seen from the 1946 Criminal Code and the 2023 Criminal Code. This thesis research uses normative legal research. The nature of the research is descriptive analysis. And the type of data used is secondary data sourced from primary, secondary and tertiary legal materials. The results of the research from this paper are two judge's decisions regarding criminal acts of theft with weights committed by children which resulted in disparities in the imposition of criminal sanctions. This disparity occurs because there is freedom for judges to impose criminal sanctions on perpetrators that have been determined by law, therefore there is a need for regulatory limitations that can provide limits for judges before making their decisions. Judges in handing down decisions must be based on juridical and sociological aspects, so that unfair judge decisions do not occur.
