Abstract

Skripsi ini berjudul: Penetapan Justice Collaborator Sebagai Unsur Yang Meringankan Dalam Penjatuhan Pidana. Wujud HAM ialah negara tetap wajib memberikan perlindungan hukum terhadap seorang berstatus hukum sebagai saksi, saksi korban, tersangka, terdakwa, ataupun terpidana. Pemenuhan hak warga negara tersebut perlu direalisasikan dalam bentuk peraturan perundang-undangan. Permasalahan yang dibahas dalam skripsi ini ialah: Bagaimana penetapan status justice collaborator sebagai unsur yang meringankan dalam penjatuhan pidana di Indonesia? Bagaimana gagasan penetapan justice collaborator melalui perbandingan hukum pidana di negara Amerika Serikat, Belanda, dan Jerman?. Jenis penelitian ini adalah normatif dengan data sekunder yang terdiri dari bahan hukum primer, sekunder, dan tersier. Adapun hasil penelitian yang didapat ialah penetapan status justice collaborator di Indonesia dan penggunaannya dalam putusan sebagai salah satu unsur yang meringankan, serta gagasan justice collaborator di Indonesia berdasarkan perbandingan hukum pidana di negara Amerika Serikat, Belanda, dan Jerman.
