Abstract

Indonesia, which was sued by IMFA for violating the Bilateral Investments Treaty (BIT), made Indonesia take steps and efforts to win the arbitration lawsuit at the Permanent Court of Arbitration (PCA). From this dispute, the existence of Krasner's Sovereignty theory becomes a point of attention in the settlement of international disputes. This research examines the initial causes of the dispute between Indonesia and IMFA's arbitration claim centered on IMFA's operations in Indonesia, as well as the implications of Sovereignty in resolving this dispute and the PCA recognizing Indonesia's sovereignty over its natural resources as a fundamental principle of international law and upholding Indonesia's right to enforce authority in its territory. This research uses descrip ye qualitative research as a research design through literature study. and shows Indonesia's steps in winning the lawsuit using Sovereignty to assert its rights in regulating natural resources and protecting its national interests. The results of this study show that Indonesia's steps and efforts are in accordance with the dimensions of Sovereignty theory, namely Domestic Sovereignty with indicators such as Legal Basis and Law Enforcement Officials and the dimensions of International Legal Sovereignty with indicators of Ratification, Participation, Legal Claims where Indonesia has taken various steps and efforts to win the case by trying to protect its legal sovereignty and fulfill the requirements in the eyes of international law Keywords: International Law, Arbitration, Conflict, Sovereignty
