Abstract

This research delved into the intricate dynamics of diplomatic immunity, particularly in the context of murder cases involving diplomats' family members, as framed by the 1961 Vienna Convention on Diplomatic Relations. Central to the research is the Convention's approach to criminal acts committed by diplomatic envoys, the rationale behind extending immunities to diplomats' families, and the legal mechanisms activated by such criminal acts. It probed the historical and pragmatic reasons for the extension of these privileges to diplomats' families, illuminating the delicate interplay between international protocol and the sovereignty of states. Employing a normative legal research inclusive of case law review, in conjuction to the Theory of Extraterritoriality, Theory of Functional Necessity and Representative Character Theory. The findings of this research indicate that while the Convention does not specifically address criminal acts within the scope of diplomatic work, it emphasizes the obligation of diplomatic representatives to adhere to local laws. It explicates the reasons for granting diplomatic immunity based on administrative rationales and the practices of customary international law, viewing them as direct representations of sovereign state leaders. Additionally, it outlines alternative dispute resolution mechanisms available before escalating a case to the ICJ, such as arbitration through the Permanent Court of Arbitration (PCA) and conciliation.
