Abstract
This research aims to explain how the strength of proving a notary deed whose face is incompetent after signing the deed and to analyze how the legal settlement of a notary deed whose face is declared incompetent in the future. Research Approach used Statutory Approach (Statute Approach), Conceptual Approach (Conceptual Approach), Case Approach (Case Approach). The results of this research explain that the Evidentiary Power of Notary Deed whose Presence is incompetent after the signing of the deed is still valid because at the time of the deed making process it is in accordance with the forms and procedures regulated by the Law. The deed which certainly has perfect evidentiary power and binds the parties because at the time of making the deed the person is still in a competent state based on Article 39 of the Notary Office Law and has fulfilled both subjective and objective elements in Article 1320 of the Indonesian Civil Code. Legal settlement of a deed whose face is declared incompetent in the future, the parties have 2 (two) settlement efforts that can be taken, namely: First, the parties return to the Notary to make a deed of cancellation of the deed in question, second, by filing a lawsuit to the court by submitting arguments and evidence to cancel the deed.
