Abstract

A notary as a public official is an official who is given a task to make an authentic deed. However, notaries do not carry out their profession, rarely summoned by the police for participating in the forgery of authentic deeds. In this case, the Notary participated together with the seller in falsifying the power of attorney deed to sell land. So, it is deemed necessary to know the Legal Responsibility Civil Notary and Seller Participating in the Forgery of Power of Attorney Deed Land that causes losses for buyers. This research aims to analyze the form of Civil Law Liability of Notaries and Sellers Participating in falsifying the Power of Attorney Deed to Sell Land which causes losses for buyers and analyze buyers' legal efforts to sue Civil Law Liability for Participating Notaries and Sellers In Forgery of Power of Attorney Deed to Sell Land. This research uses the method of normative research, using primary, secondary, and legal materials, and uses a statutory and regulatory approach analysis. The results of this research explain that a notary can be requested for civil and administrative liability, and claims against the Notary in civil form in the form of reimbursement of costs, compensation, and interest. As a result, a notary's deed has the power of proof as a private deed or null and void, and the notary is held administratively liable with administrative sanctions, namely in the form of temporary dismissal of the seller declared responsible for any adverse consequences that occur due to his actions were wrong. The unlawful act he committed causes losses and the seller is obliged to compensate for the losses suffered by the seller buyer. The Buyer's legal remedy is to file a lawsuit in court to request reimbursement of costs, compensation, and interest for the seller's actions having committed an unlawful act by selling land that is not the right to use a fake power of attorney to sell.
