Abstract
The writing of this thesis is motivated by the application of law to the implementation of electronic registration of fiduciary guarantees by fiduciary recipients which has not been implemented optimally, causing no compatibility between applicable legal rules and the application of existing laws in legal practice in the field. The Fiduciary Beneficiary as an applicant in the Electronic Registration of Fiduciary Guarantees may bring legal action independently. So far, it is known that in the legal world of fiduciary guarantees, if the Fiduciary Recipient wants to register the Fiduciary Guarantee Electronically, it can only be through Notary legal services as the Power of Attorney from the Power of Attorney, namely the Fiduciary Beneficiary on a legal basis, namely based on Law Number 42 of 1999 concerning Fiduciary Guarantee. Regulation of the Minister of Law and Human Rights Number 25 of 2021 concerning Registration Procedures, Amendment, and Removal of Fiduciary Guarantees. In this writing, the purpose of this study is to find out whether it has been implemented against the rule of law that the Fiduciary Beneficiary as a party to the fiduciary guarantee agreement as well as the applicant can apply for Electronic Registration of Fiduciary Guarantee by the Fiduciary Beneficiary as the rule has been applied as the applicant's right to be able to register the Fiduciary Guarantee Electronically through the Online Fiduciary Application and to analyze and find out the constraints which appears in the Application of Law to the Implementation of Electronic Registration of Fiduciary Guarantees by Fiduciary Recipients The research method used in this Thesis Research is Normative Type Research and uses the methods of Statutory Research Approach and Conceptual Approach.
