Abstract

ABSTRACT It often happens that the Land Deed Official is involved in legal cases regarding the material truth of the deed he made either because of the fault of the Land Deed Official himself or the fault of the parties. This gives rise to liability both acting individually and acting through position. This thesis discusses the problem of the regulation of the responsibility of the Land Deed Official for the material truth of the deed he made and future legal arrangements regarding the legal responsibility of the Land Deed Official for the material truth of the deed he made. The research method used is normative legal research by analyzing primary legal materials, secondary legal materials, and tertiary legal materials. This research found that the legal responsibility of the Land Deed Official is divided into two, namely as an individual and as a public official. The Land Deed Official is responsible as an individual if the Land Deed Official knows the violation of the material truth made by the parties. If the Land Deed Official commits a violation regarding the formal truth, then the Land Deed Official is obliged to be responsible and act in office, and for the violation, the PPAT is given sanctions in accordance with applicable laws and regulations and it is hoped that in the future confirmation can be made regarding the separation of the legal responsibility of the Land Deed Official formally and materially. This writing recommends that the regulations regarding the responsibility of the Land Deed Official must be stated firmly and easily understood and there is a need for confirmation of the legal responsibility of the Land Deed Official for the material truth of the deed he made which states that the Land Deed Official is not responsible for the material truth of the deed he made, so that there are limits that must be carried out in the law enforcement process.
