Abstract

The provisions of the Labor Law do not specifically yet regulate about theretirement age limit for workers so that it does not provide protection for workers.This is the reason there are still the rights of Retirement Age Workers are notprotected yet. The purpose of the study was to analyze the legal protection forworkers entering retirement age to obtain severance pay rights and the legalconsequences if the company does not provide severance pay rights for workersentering retirement age. This research used normative legal research that aimed toproducing argumentations, theories or new concepts as prescriptives in solving theproblems faced. The approach used (Statute Approach), (case approach). Analysisof legal materials uses qualitative analysis and taking deductive conclusion. Theresults showed that "for the first time the retirement age has been set at 56 (fiftysix) years". However, in reality the company does not respond, so the workersrights that should be given to workers will be difficult to obtain. Apart from thefact that the retirement age limit for workers is not regulated, there was a lack ofsupervision and law enforcement carried out by the relevant agencies when thecompany is not willing to retire workers, it is difficult for workers to get theirseverance pay rights. The legal consequence with is not paid severance pay in fullto workers is that the workers are disadvantaged because their rights are not fullyfulfilled by the company so that this gives rise to legal consequences in the formof warnings and sanctions to the company by giving fines. warnings to thecompany, this is mandatory every act that violates the law, which causes harm toother people, requires the person who, because of his fault, to compensate for theloss, so the company which has caused harm to the workers, in this case thecompany, should be given sanctions by the Manpower Department.
