Abstract

Penelitian berjudul "RATIO DECIDENDI HAKIM DALAM MEMUTUS PERKARA TINDAK PIDANA MELARIKAN PEREMPUAN DI BAWAH UMUR (Studi Putusan Nomor 134/Pid.B/2021/PN Rah dan Putusan Nomor 18/Pid.B/2021/PN Bek)" yang dalam hal ini rumusan masalahnya yaitu mengenai pengaturan perundang-undangan tindak pidana melarikan perempuan di bawah umur dan ratio decidendi hakim dalam memutus perkara tindak pidana melarikan perempuan di bawah umur pada Putusan Nomor 134/Pid.B/2021/PN Rah dan Putusan Nomor 18/Pid.B/2021/PN Bek. Dengan menggunakan metode penelitian normatif yang bertitik tolak dengan berdasarkan peraturan perundang-undangan serta putusan terkait, hasil penelitian pada rumusan masalah pertama penulis uraikan mengenai peraturan perundangan terkait tindak pidana melarikan perempuan di bawah umur. Hasil penelitian dalam rumusan masalah yang kedua yaitu, pada Putusan Nomor 134/Pid.B/2021/PN Rah (aspek yuridis: seluruh unsur dakwaan terpenuhi, aspek non yuridis: Terdakwa sopan di persidangan dan belum pernah dihukum), pada Putusan Nomor 18/Pid.B/2021/PN Bek (aspek yuridis: seluruh unsur dakwaan terpenuhi, aspek non yuridis: Terdakwa merupakan tulang punggung keluarga dan belum pernah dihukum).
