Abstract

The position held by a notary/PPAT is one of trust; as a trustee, the notary/PPAT is obliged to keep the contents of the deed confidential in accordance with Article 16 of the UUJN, but a new obligation has emerged, namely that the notary/PPAT must report suspicious financial transactions as stipulated in PP 61/2021, which is the implementing regulation of the Anti-Money Laundering Law 8/2010. This is certainly a polemic among notaries and PPATs because, on the one hand, notaries and PPATs are required to keep their positions confidential, and on the other hand, notaries and PPATs must report. The problems discussed in this thesis are the implications of the obligation of the notary/PPAT as a reporting party and the protection for the notary/PPAT to maintain confidentiality related to his obligation as a reporting party. The research method used is normative legal research with a legal approach, a conceptual approach, and a theoretical approach. The research was conducted by analyzing primary, secondary, and tertiary legal materials. Based on the results of the discussion, it is found that the implication of PP 61/2021 is that it materially binds the notary/PPAT as a reporting party in PPTPPU, which requires the notary/PPAT to apply the principle of recognizing service users, and if the notary/PPAT knows that there is an act suspected of TPPU, the notary/PPAT is asked to immediately report to PPATK. If not reporting, the notary or PPAT may be subject to sanctions. Legal protection for notaries and PPATs to maintain the confidentiality of the office is provided by the UUJN and the Code of Ethics as guidelines for notaries and PPATs in carrying out their duties and authorities. UUJN and the code of ethics of the notary/PPAT as lex specialis, while Law 8/2010 PPTPPU as lex generalis, but in maintaining the secrets of the office, there are limitations, namely higher interests, or by something, the applicable laws and regulations expressly exempt him from the oath of the secrets of his office.
