Abstract

Work plays an important role in a person's daily life, as exemplified by the Indonesian Constitution. One example of a job that Indonesian workers are engaged in is the crew member of a ship, also known by the abbreviation ABK. Regardless of the national or international scene, Indonesia is the only country after China and Russia that places crew members on foreign ships. According to data presented by the National Agency for the Placement and Protection of Indonesian Workers (BNP2TKI), Indonesia holds the title as the country with the largest maritime workforce in the world. This qualitative approach is widely used by social researchers as a scientific method that aims to enrich the research results of academics. In the future, this type of research is useful for developing knowledge, discovery, and understanding. In achieving the researcher's objectives, this research uses a qualitative descriptive study which is a method for researching by reviewing documents and analyzing a phenomenon, event, or event that occurs regarding Indonesia's passive compliance factors towards the application of the MLC regime in the case study of fishery vessel crew. The following are the factors of Indonesia's passive compliance in implementing the MLC 2006 regime in the case study of fisheries crew slavery: weak data collection and certification, weak international legal framework, and weak socialization about fisheries. The ratification of the MLC 2006 through Law No. 15/2016 plays an important role for Indonesia, increasing the protection and fulfillment of the rights of Indonesian seafarers. Although Indonesia has ratified the 2006 ILO Maritime Labour Convention, the forms of seafarer protection contained in the convention have not been able to fully secure protection for all seafarers. The 2006 ILO Maritime Labour Convention expressly excludes the application of seafarers of fishing crews, as explained in Article 2 paragraph 4 of the 2006.
