Abstract

Pada penelitian ini, penulis menganalisis mengenai tempat kediaman tergugat yang dikategorikan sebagai alamat yang tidak jelas sehingga menjadi dasar tidak diterimanya gugatan. Tujuan dari analisis ini yaitu: 1. Untuk mengetahui dan menganalisis alasan hakim tidak dapat menerima suatu gugatan karena tidak jelasnya alamat, dan 2. Untuk mengetahui dan menganalisis indikator suatu alamat dapat dikatakan sebagai alamat yang tidak jelas. Penelitian ini menggunakan jenis penelitian normatif dengan menggunakan pendekatan peraturan perundang-undangan (statue approach) dan pendekatan kasus (case approach). Hasil analisis menunjukkan bahwa dasar pertimbangan hakim untuk memberikan amar bahwa gugatan tidak dapat diterima pada Putusan Nomor 606/Pdt.G/2023/Pa.Plg didasarkan pada Pasal 8 Nomor 3 Reglement Op de Burgerlijke Rechtsvordering (RV) yang memuat aturan mengenal hal-hal pokok yang ada pada gugatan.
