Abstract

Kebutuhan masyarakat yang semakin meningkat dalam berbagai aspek kehidupan mendorong pentingnya akta dalam mempertahankan dan melindungi hak warga masyarakat. Notaris menjadi salah satu pejabat publik yang dapat membuat akta sebagai alat pembuktian yang kuat. Pembuatan akta harus sesuai dengan keterangan para pihak. Namun keterangan ini terkadang dibuat palsu atau berbeda dari fakta yang sebenarnya sehingga dapat membuat akta menjadi palsu. Dalam pencarian pembuktian akta palsu maka Notaris harus diperiksa oleh penyidik. Sedangkan Notaris memiliki undang-undang sendiri yang dapat menolak panggilan penyidik. Berdasarkan hal tersebut, Mahkamah Konstitusi mengeluarkan putusan bahwa pemanggilan Notaris tidak harus dari izin Majelis Pengawas Daerah (MPD).
