Abstract

Rokok elektronik atau e-cigarette mulai digemari masyarakat Indonesia, rokok elektronik itu sendiri memerlukan cairan liquid perisa untuk menghasilkan uap yang serupa dengan asap rokok. Banyaknya minat konsumen terhadap cairan liquid dimanfaatkan pelaku usaha yang tidak bertanggung jawab dengan tidak mencantumkan tanggal kadaluarsa yang tidak sesuai dengan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Hal tersebut menyebabkan banyaknya pertanyaan mengenai perlindungan hukum terhadap konsumen terkait penjualan cairan liquid perisa yang tidak mencantumkan label peringatan berbahaya dan untuk mengetahui sanksi terhadap pelaku usaha yang tidak bertanggung jawab terhadap konsumen dan sanksi terhadap pelaku usaha yang tidak mencantumkan label peringatan berbahaya. Penelitian ini menggunakan metode penelitian normatif. Perlindungan konsumen terkait dengan penjualan cairan liquid yang tidak mencantumkan label peringatan berbahaya telah diatur dalam Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Apabila konsumen menderita kerugian akibat tidak jelasnya informasi yang didapat maka konsumen berhak mendapatkan ganti rugi dan pelaku usaha berkewajiban untuk bertanggung jawab.
