Abstract

Sebelum dan sesudah diundangkan undang2 12 tahun 2022 tentang tindak pidana kekerasan seksual uu tpks mayoritas putusan terhadap terdakwa pelaku kekerasan seksual tidak mengandung amar yang menjatuhkan hukuman terdakwa membayar resitusi, karena aparat penegak hukum hanya berfokus kepada pemidanaan dan belum memperhatikan kepentingan korban atas hak asasi manusia korban memperoleh rsitusi penelitian ini adalah penelitian hukum normatif menggunakan data sekunder yang diperoleh dari studi kepustakaan ditunjang dengan hasil wawancara sebagai data primer yang diperoleh sari studi lapangan kemudia dianalisi secara kuantitatif
