Abstract

ABSTRACT Islamic Court (Pengadilan Agama/PA), as the executor of judicial power, is the sole state institution authorized to settle Sharia economic cases through litigation. In carrying out this authority, ideally (das sollen), the PA should have its own procedural law (formal law) that aligns with the characteristics of Sharia economic substantive law, integrated, precise, systematic, comprehensive, and harmonious, consistent with the philosophical values contained in Pancasila as the legal foundation of the Indonesian nation. This is intended to ensure that the applied procedural law functions as it should to uphold both formal truth and Sharia economic substantive law within the national legal framework. However, in practice, the resolution of Sharia economic cases in the PA utilizes civil procedural law derived from pluralistic legislation, including H.I.R, R.Bg, RV, BW/KUH Perdata, KUHD, and various other related regulations. This research aims to trace, reveal, and analyze the philosophical, juridical, and sociological aspects of the procedural law construction applied in settling Sharia economic cases and its role in realizing legal certainty and upholding Sharia principles. Using a normative legal research method through the approaches of legal philosophy, legal dogmatics, legal history, legislative approach, legal comparison, legal politics, and case approach. This research reveals that the current construction of Sharia economic procedural law in the PA is not fully grounded in a harmonious, consistent, and consequent philosophical foundation with the principles and principles of Sharia economics and the values inherent in Pancasila. From a juridical and sociological perspective, there are several legal issues at both normative and empirical levels, thus not fully achieving legal certainty and upholding Sharia principles. The concept of reconstructing Sharia economic procedural law in the future must be aligned with Sharia principles and the values inherent in Pancasila and the 1945 Constitution. Its formation should refer to the principles and norms stipulated in relevant legislation as well as the values prevalent in society. This way, a Sharia economic procedural law that fulfills its function, to achieve legal certainty and uphold Sharia principles, will be established, relevant to the legal aspirations of the Indonesian nation.
