Abstract

Penelitian ini bertujuan untuk menganalisis bagaimana pertimbangan hukum hakim dalam memutus perkara PT Asuransi Syariah Mubarakah yaitu Putusan Nomor 1016 K/Pdt.Sus-Pailit/2016 dan akibat hukum yang diterima oleh PT Asuransi Syariah Mubarakah. Metode penelitian yang dilakukan yaitu hukum normatif, dengan pendekatan undang-undang, dan teknik analisis kualitatif. Kepailitan Asuransi Syariah Mubarakah merupakan perkara kepailitan asuransi syariah pertama di Indonesia. Terdapat beberapa persoalan perihal bagaimana pertimbangan hukum kepailitan asuransi syariah baik dari segi prosedur maupun substansi, antara lain mengenai legal standing dari pemohon kepailitan PT Asuransi Syariah Mubarakah, pelanggaran asas nebis in idem, likuidasi atau kepailitan PT Asuransi Syariah Mubarakah, asas sederhana dalam kepailitan perusahaan asuransi ini sudah tepat dan tidak bertentangan berdasarkan perundang-undangan dan adapun akibat hukum dari PT Asuransi Syariah Mubarakah yaitu mengalami kepailitan dikarenakan syarat kepailitan yang sudah terpenuhi dan beberapa jumlah utang yang sudah melebihi aset yang dimilikinya.
