Abstract

This research aims to explain the role of a notary's authority at class II auction officials by analyzing cases in which decisions have been issued, with the judge's considerations in issuing decisions, and examining the authority of class II auction officials as regulated in Ministry of Finance regulations. The research method used is normative law, namely legal research literature or secondary data with primary, secondary and tertiary sources of legal materials. Research approaches applied to laws, contexts, and cases. In this case, the Class II Auction Officer Notary together with the Auction House conducted a voluntary auction, where the object had changed the name of the auction minutes which had been issued by the Class II Auction Official Notary. In this case, the winner of the auction who has changed his name has full legal authority, therefore this legal action, the plaintiff who considers the defendant to have committed an unlawful act, where the object of the auction should be a court confiscation and the minutes of the auction will be cancelled. In preliminary decisions the district court and high court ruled that the auction was legal. However, at the cassation level at the Supreme Court, the judge decided to cancel the auction minutes, which was detrimental to the plaintiff because of the district court decision No.102/PDT.G/2002/PN.Jak-Sel. Deciding that the object is real is the site's guarantee.
