Abstract

Bagaimana penerapan asas koneksitas Perkara Penggelapan yang dilakukan oleh TNI pada Putusan Nomor Nomor 85-K/PM I-04/AD/VIII/2024 dan Bagaimana penjatuhan sanksi terhadap TNI yang melakukan Tindak Pidana Penggelapan dilihat dari Kitab Undang-Undang Hukum Pidana Militer Putusan Nomor 85- K/PM I-04/AD/VIII/2024 koneksitas merupakan sebuah proses hukum acara yang berkaitan Langsung dengan 2 (dua) peradilan, yakni Peradilan Militer dan Peradilan Umum. Penelitian ini menggunakan metode penelitian normatif. Pendekatan Perundang-undangan dan Pendekatan Kasus. Putusan Nomor 62-K/PM 1 04/AD/V 2023 telah melakukan pemidanaan sesuai dengan penerapan asas koneksitas yang berkaitan dengan teori pemidanaan yang mana terdakwa yang merupakan Anggota TNI AD telah dihukum dengan pidana penjara selama 7 (tujuh) bulan dan pidana tambahan berupa dipecat dari dinas militer. Penjatuhan Saksi terhadap terdakwa berupa Penjara selama 7 (tujuh) bulan dan pidana tambahan berupa Pemecatan Dari Dinas Militer
