Abstract

Access to education is one part of human rights, particularly in terms of economic, social, and cultural rights. However, access to continuing formal education to higher level is still a major problem. One of the constraints of the fulfillment of the right to continue formal education is insufficient capacity of state to provide core of minimum obligation related to access education. This article are normative perspectives that demonstrate how the failure to meet the minimum core obligation considered as violation against human rights, especially in terms of access to education.
