Abstract

Skripsi ini berjudul “Perbandingan Kebijakan Hukum Pidana Contempt Of Court Di Indonesia, Inggris, Dan Rusia”. Dalam tulisan ini, Penulis melakukan suatu perbandingan hukum dengan melihat produk hukum mengenai contempt of court pada Negara Indonesia, Inggris dan Rusia. Adapun tujuan dari penelitian ini adalah: 1. Ulntulk mellngelltahuli dan mellnganalisis pellngatulran tindak pidana colntellmpt olf colulrt di Nellgara Indolnellsia, Inggris dan Rulsia, 2. Bagaimana kedudukan norma Schuld dalam pengaturan tindak pidana colntellmpt olf colulrt di Indonesia, Inggris, dan Rusia. Penelitian ini menggunakan jenis penelitian normatif dengan menggunakan pendekatan peraturan perundang-undangan (statue approach) dan pendekatan komparatif. Hasil penelitian ini mengungkapkan adanya beberapa persamaan dan perbedaan dalam pengaturan contempt of court di tiga negara tersebut. Pellrsamaan yang ditellmulkan di antaranya: pellngatulran mellngellnai colntellmpt olf colulrt, Rulang lingkulp colntellmpt olf colulrt, dan olbjellk dari colntellmpt olf colulrt yang telah diterapkan pada ketiga negara tersebut. Selldangkan pellrbelldaan yang ditellmulkan diantaranya: Klasifikasi jellnis colntellmpt olf colulrt, Prosedur pellnjatulhan pidana colntellmpt olf colulrt, sellrta Batasan terhadap colntellmpt olf colulrt itu sendiri, yang diatur pada ketiga negara tersebut. Serta hasil penelitian menunjukan bahwa adanya perbedaan penegakan norma schuld. Negara Indonesia dan Rusia menerapkan norma schuld yang terletak pada mekanisme penjatuhan pidana contempt of court. Serta Negara Inggris dengan asas berbeda pada penjatuhan pidana contempt of court yakni asas strict liability.
