Abstract

The research conducted in this paper is on the regulation of criminal offenses and criminalization of same-sex sexual abuse in three countries, namely, Indonesia, Malaysia and Brunei Darussalam. The method used to examine this research is through a normative qualitative approach to the norms of criminal law and punishment that apply in the three countries. The results show that the regulation of same-sex sexual abuse in the three countries is different. Indonesia regulates its material law norms in Law Number 1 of 1946 with the provision that the perpetrator is an adult and the victim is a child and Law Number 1 of 2023 with the provision that the act is committed in a public place, or with violence, or published as pornographic content, while the procedural law in Indonesia uses Law Number 8 of 1981. Malaysia regulates it in the Kanun Keseksaan (Akta 574) with the provision that the act is committed either consensually or by force, along with the procedural law using the Kanun Procedure Jenayah (Akta 593). Brunei Darussalam regulates it in the Kanun Hukuman Jenayah Syariah 2013 with the provision that the act is committed either consensually or by force, and the procedural law used is the Order of Information of the Syariah Court 2002. Indonesia punishes the perpetrators with fines and imprisonment which leads to retributive punishment. Malaysia threatens offenders with imprisonment and sebat which also leads to retributive punishment. Brunei Darussalam punishes offenders with fines, imprisonment, sebat, stoning, and detention in a recovery center for offenders who have not reached puberty. Punishment in Brunei leads to retributive punishment for offenders who have reached puberty, while for offenders who have not reached puberty Brunei applies preventive punishment.
