Abstract

Guru honorer memiliki peran penting dalam mendukung keberlangsungan pendidikan, namun realitas menunjukan bahwa banyak guru honorer masih menerima upah yang jauh dari standar kelayakan hidup, dalam UUD 1945 Khususnya pasal 27 ayat (2) dan pasal 28D ayat (2) telah menjamin hak setiap warga negara untuk memperoleh pekerjaan dan penghidupan yang layak. Penelitian ini bertujuan untuk mengetahui bagaimana kebijakan pemerintah terkait pemenuhan hak konstitusional guru honorer atas upah yang layak serta faktor yang mempengaruhi tidak terpenuhinya hak konstitusional guru honorer terkait upah yang layak. Metode penelitian ini adalah penelitian hukum normatif dengan mengkaji berbagai peraturan perundang-undangan yang berkaitan dengan permasalahan, serta penarikan kesimpulan secara deduktif. Data dari penelitian ini diperoleh dari berbagai sumber seperti, buku, jurnal, doktrin serta internet. Adapun hasil dari penelitian ini (1) Kebijakan yang telah dibuat pemerintah seperti Undang Undang Nomor 14 Tahun 2005, Undang-Undang No 20 Tahun 2023, Peraturan Pemerintah Nomor 56 Tahun 2012, Peraturan Pemerintah Nomor 49 Tahun 2018, Permendikbud Nomor 63 Tahun 2023, namun implementasi di lapangan masih belum optimal, (2) Faktor yang mempengaruhi tidak terpenuhinya upah yang layak bagi guru honorer yaitu, Faktor struktural, faktor substansi hukum, dan faktor budaya hukum.
