Abstract

Notaries as public officials who are authorized to make authentic deeds have an important role in ensuring legal certainty. Notaries in carrying out their duties and positions must work professionally and uphold the applicable norms and regulations and will not be separated from the notary code of ethics. In this increasingly modern era, the need for notaries is also increasing and of course business competition between notaries is also increasing. Along with the many Notaries who are appointed every year by the Ministry of Law and Human Rights, it also influences the activities of Notaries in carrying out their duties, disrupting the balance that has existed so far, Notaries who cannot compete will lose the opportunity to get clients or what we can call appearers. While Notaries who can also compete will not necessarily get clients because the way each Notary gets clients will be different. The increasing business competition between notaries then gives rise to unfair business competition, especially among notaries in Palembang City. This thesis discusses the implementation of Article 4 of the Notary Code of Ethics relating to unfair business competition, as well as the challenges and solutions that can be applied to maintain the integrity of the notary profession. The Notary Supervisory Board and the Notary Honorary Council are expected to be more active in supervising and coaching Notaries, and changes should be made to the authority held by the Regional Supervisory Board, so that they can provide sanctions to Notaries who violate the Notary Code of Ethics not only from complaints, but also with their own discovery of the violation.
