Abstract
The Indonesian government guarantees legal certainty of land ownership for its citizens through the Basic Agrarian Law (UUPA) No. 5 of 1960. Land has high strategic and economic value, thus requiring valid proof of ownership. An authentic deed prepared by a Land Deed Official (PPAT) serves as valid legal evidence for registration at the Land Office, especially for the transfer or encumbrance of land rights or ownership rights over apartment units. This study examines the legal protection for PPATs whose deeds cannot be registered at the Land Office, the legal remedies available to land rights holders in such situations, and possible future regulations concerning deeds that are unregistrable despite prior certificate checks and deed execution by the PPAT. The research method used is normative, with a legal, philosophical, and academic approach through laws, scientific literature, books, and journals relevant to the thesis topic. The analysis is based on primary, secondary, and tertiary legal sources, supported by the theories of legal certainty, legal protection, legal evidence, and good governance.The findings show that every legal act concerning land rights must comply with applicable legal provisions and procedures. This includes verifying land certificates before executing the deed, in order to provide legal protection for both the PPAT and the involved parties. If the PPAT has already conducted a certificate check and found no issues, and the deed complies with all legal requirements, but the deed still cannot be registered due to overlapping claims, excess land area, or a certificate block, the land rights holder may submit a legal application to the Land Office without holding the PPAT accountable. The Land Office will then examine the case and attempt to resolve the issue through amicable discussion. If no fair resolution is reached, the land rights holder may file a lawsuit in court. Future regulations should require the Land Office to be more thorough and accurate in issuing certificate checks, so that no party is harmed. This is because PPATs rely on these checks to proceed with the preparation of deeds for transferring or encumbering land rights. In conclusion, Government Regulation No. 24 of 1997 serves as a guarantee of legal certainty in land ownership. Keywords: PPAT Deed, Deed Registration, Legal Protection, Legal Certainty
