Abstract
nformation technology and communication development have transformed society’s behaviors and human civilization, causing the emergence of cyber crimes. One of the cyber crimes is online gambling. In Indonesia, this issue is regulated in Law Number 11 of 2008 concerning Electronic Information and Transactions as amended by Law 19 of 2016. This analysis examines the North Jakarta District Court Decision Number 1248/Pid.B/2021/PN.Jkt.Utr concerning the crime of gambling. This study explores the judges’ legal considerations related to the crime of gambling in judgment as the first point in the problem formulation. The second point in question is whether the judge could decide the case differently from the article of charge. This analysis employs a normative legal research method using secondary data with a case approach and a statutory approach. Several points can be drawn from the analysis. Some of the legal issues from the decision were incorrect articles of charges, meaning that the judge did not formulate the articles of gambling in Article 27 paragraph (2) of Law 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions and Article 65 of the Criminal Code concerning concursus realis in the charges, prosecutions, and decisions. The articles must be formulated precisely and meticulously because errors in formulating articles in charge could have significant implications for the trials.
