Abstract

With the enactment of Law Number 1 of 2023 concerning the Criminal Code, the criminal provisions in the Regional Regulations must be changed and adjusted based on Law Number 1 of 2023. The formulation of the problem in this paper is How to prepare changes to the criminal provisions of regional regulations after the enactment of Law No. 1 of 2023 concerning the Criminal Code, What challenges are faced and how to conceptualize the preparation of changes to criminal provisions in regional regulations after the enactment of Law Number 1 of 2023 concerning the Criminal Code. The research method used for this research is normative legal research. tThhe criminal provisions in Regional Regulations must be changed and no longer regulate criminal sanctions in confinement. The challenge encountered in changing the drafting of criminal provisions in Regional Regulations: the shortage of State Civil Apparatuses as drafters of regional law products, the Regional Regulations in each region which contain criminal provisions are very large. Considering that there are a large number of Regional Regulations that contain criminal provisions, the Regional Regulations currently in force to must adapt and to be read the same as Article 613 paragraph (2) of Law Number 1 of 2023 concerning the Criminal Code. This aims to maintain uniformity and legal certainty in the implementation of enforcement of Regional Regulations. Keywords: Criminal Provisions, Regional Regulations, Criminal Code
