Abstract

Fulfillment of land owners' in repeated Sale and Purchase agreement often occurs in practice, one of which is the case in District court Decision Number: 840/Pdt.G/2020/PN.Dps where the deed of the main agreement of the repeated sale and purchase binding agreement which contains a defect of will has the legal effect of being invalid and null and void because it does not meet the objective requirements so that the arising bonds including derivative agreements or accesoir agreements issued as well as the transfer of land rights originating from the splitting of the whole land plot are null and void, this is done in order to fulfill the rights of the landowner (seller). This research used a normative legal method with the aim of analyzing the problem of the form of fulfillment of landowners' rights in the repeated Sale and Purchase Binding Agreement. The results shoewed that an agreement must meet the subjective and objective requirements, the otarys must also have the courage to reject the request of the parties or the confroontants who ask to make a repeated Sale and Purchase Bidning Agreement or repeated Sale and Purchase Binding because based on current tax regulations, int the transfer of land rights for the making of a sale and purchase deed until the name change process there is income tax (PPh) that must be borne by the seleler ant the Fees for acquistion of land and Building Rights (BPHTB) bone by the buywer. However, in practive, the Repeated Sale and Purchase Agreement is carried out by parties, especially buyers who deliberately avoid paying taxces and deliberately avoid paying taxes.
