Abstract

Various laws and regulations issued by the government must be implemented and enforced if there are violations. The state, in this case the government, is responsible for ensuring that the rules in the legislation are implemented. In enforcing these rules, legal sanctions are used. This research is normative research, namely research on legal principles related to policy formulation for the use of criminal sanctions in administrative law. The existence of legal sanctions is necessary because with the threat of punishment it is hoped that spiritual coercion and educational influence can be achieved on those concerned. One of the threats of punishment is criminal sanctions. Enforcement of State Administrative Law by criminal law is about sanctions. The importance of criminal sanctions in enforcing State Administrative Law by Criminal Law can be seen from Logeman's opinion quoted by Soehardjo Sastrosoehardjo that State Administrative Law provides rules that guide the government's participation in socio economic relations, namely rules that the government itself sanctions in violation matters. In formulating policies or efforts to form criminal law regulations, we must pay attention to what and how the appropriate punishment formulation is for a criminal act so that the goal of crime prevention can be achieved. So far, no research has been conducted on the use of criminal law in administrative law, what policies have been pursued and what policies must be pursued in the use of criminal law in administrative law. Tracing the use of criminal law regulations in the field of administrative law is a necessity because it will reveal various weaknesses and how far changes need to be made.
