Abstract

This thesis is entitled “Imposition of Sanctions on Officials of the National Land Agency (BPN) Due to the Annulment of Legal Products by the Court.” This research formulates the problems concerning the mechanism for imposing criminal and administrative sanctions on BPN officials and the procedures for the annulment of BPN's legal products by the court. This study employs a normative qualitative research method. The mechanism for imposing sanctions can be applied to National Land Agency (BPN) officials if they comply with the case resolution process. If a BPN official faces legal issues, they are entitled to legal protection and assistance from the Ministry. However, if an official fails to comply with resolving the case, they may receive light sanctions such as verbal warnings, written warnings, and written statements of dissatisfaction. In addition, the procedure for annulling BPN's legal products by the court begins with the existence of duplicate land certificates, followed by the submission of a lawsuit to the Administrative Court (PTUN), examination and decision by PTUN, a legally binding decision (inkracht), a request for execution to PTUN, PTUN issuing an execution order to BPN, and finally, BPN revoking the duplicate certificate. If the National Land Agency (BPN) still does not comply, the BPN official may be subject to forced execution, in which the victim may proceed with the case to be executed by a court bailiff. Therefore, the BPN must increase its awareness in handling legal cases and exercise greater caution in the issuance of land certificates. Keywords: National Land Agency (BPN), Sanctions, Court
